We have reviewed your submittal of June 1,1978 which provided additional information and justification, as well as revised pages to your Fundamental Nuclear Material Control Plan (XN-12, Rev. 8, July 1978), concerning your request of November 23,1977 for a new license condition to clarify the accounting practices for aranium-235 values.

We have found the additional information and revisions to XN-12 to be acceptable, and thus are issuing a new License Condition 6.6 to Amendment MPP-2 of your License No. SNM-1227. We are also revising License Condition 2.1 of the same amendment in order to incorporate your XN-12 revisions.

Both license conditions are effective immediately, and read as follows:

2.1 The licensee shall follow the fundamental nuclear material control plan titled, " Nuclear Materials Safeguards Procedures Description for the Fuels Fabrication Plants", XN-12, Rev. 5, dated February 1977; as amended May 20, 1977 (pages dated April 1977, Rev. 5), October 17, 1977 (pages dated September I W 7, Rev. 6), and June 1, 1978 (pages dated July 1978, Rev. 8);

and as may be revised in accordance with the provisions of 10 CFR 70.32(c).

6.6 Notwithstanding the requirement of 10 CFR 70.51(f)(1)(i), the licensee may use, for material accounting purposes, the U-235 enrichment of UF6 or UO2 receipts, as determined by measurement, for the U-235 content of UO2 powder and UO2 pellets derived from such receipts provided that material identity and isotopic integrity are maintained and provided that such U-235 values are verified by measurement as specified in Section 3.7 of the Plan identified in Condition 2.1.

e We have determined that your letter and enclosures dated June i, 1978 contain informatioa of a type specified in 10 CFR 2.790(d).

Accordingly, pursuant to Section 2.790(d)(1), such information is deemed to be commercial or financial information within the meaning of 10 CFR 9.5(a)(4) and shall be subject to disclosure only in accordance with the provisions of 10 CFR 9.12.
