I am responding to your Petition dated October 18. 1996. filed on behalf of Don't Waste Michigan and the Lake Michigan Federation (Petitioners) pursuant to Section 2.206 of Title 10 of the Code of Federal Regulations (10 CFR 2.206).

In the Petition, you requested that the U.S. Nuclear Regulatory Commission take action to accomplish the following:

Prohibit loading of Ventilated Storage Casks (VSC-24s) until the certificate of compliance (C0C). the safety analysis report (SAR).

and the safety evaluation report (SER) are amended following an independent. third-party review of the VSC-24 design. to address concerns raised by the Petitioners' engineering consultant.

The NRC staff's determinations that your Petition did not require immediate actions were explained by letter dated December 10. 1996.

For the reasons stated in the enclosed Director's Decision (DD-97-15) your Petition is denied.

filed with the Office of the Fedcral Register for publication.
