gentlemen.

This afternoon we have one item for 4

affirmation.

Before asking the Secretary to walk us 5

through the item, do any of my fellow Commissioners have 6

any comments to make?

If not, Mr. Secretary, proceed.

9 MR. BATES:

Mr. Chairman, we need to vote to hold 10 this item on less than one week's notice.

12 MR. BATES:

Mr. Chairman, the item today is SECY 13 88-43, Proposed Final Rule Revising Agency Procedures 14 Governing Ex Parte Communications and Separation of 15 Functions.

16 The Commission is being asked to act on final 17 amendments to 10 CFR parts 0 and 2 that revise the 18 Commission's Ex Parte and Separation of Functions' Rules.

19 The amendments update the existing rules by l

20 incorporating requirements imposed by the government in j

21 the Sunshine Act as it relates to Ex Parte communications.

22 The final rule also allows members of the PRC 23 Staff to serve as confidential advisors to the commission 24 with respect to a contested proceedings so long as those 25 Staff members do not act as investigators or litigators in

1 the proceeding.

2 This rule is intended to aid in maintaining 3

effective communication between decision-making officials 4

and the NRC Staff personnel and individuals outside the 5

NRC while ensuring the proceedings are conducted in an i

6 impartial manner.

7 All Commissioners have approved the final 8

amendments.
