Dear Ladies and Gentlemen:
I wish to advise you of the following:
- 1. At approximately 11:30 a.m. on October 31, 1978, Mr. Gregory Kainer telephoned me concerning a letter he had written to me. I told Mr. Kainer that, because of our Rules of Practice, I could not discuss any pending matters with him. Mr. Kainer proceeded to state that on October 28, 1978, he had received the Board's Order Scheduling Special Prehearing Conference dated October 24, 1978, and that, in substance, he would be unable to complete the numerous contentions by the due date of November 2, 1978. In response to my question, Mr. Kainer stated the Board's secretary had not reached him by telephone to notify him of the contents of the Order of October 24. I stated that he should do his best to comply with the Board's Order of October 24 and that we would rule on whatever was contained in his letter after we re-ceived responses thereto. I further stated that the Special Prehear-ing Conference will proceed to be held as scheduled on November 17.
- 2. The Board has received numerous mailgrams and letters from petitioners for leave to intervene. (I now find that Mr. Kainer's mailgram has also been received.)' All petitioners for leave to inter-vene, as well as the parties herein, are herewith notified that the Special Prehearing Conference will be held as scheduled on November 17, and that every effort should be made to file the submissions by the due date of November 2, 1978. The aforementioned mailgrams and letters, as well as any responses thereto, will be discussed,among other matters, at the Special Prehearing Conference. It should be noted that 10 C.F.R. 2.714 provides that additional time for filing the supplement (of con-tentions) may be granted upon the balancing of the following factors:
(i) Good cause, if any, for failure to file on time.
(ii) The availability of other means whereby the petitioner's interest will be protected.

- 4 t (iii) The extent to which the petitioner's participation may reasonably be expected to assist in developing a sound record.
(iv) The extent to which the petitioner's interest will be represented by existing parties.
(v) The extent to which the petitioner's participation will broaden the issues or delay the proceeding.
