Discussion:
The comprehensive audit of existing and proposed NRC supergrade positions was discussed in considerable detail in SECY-78-97.
That detailed discussion will not be repeated here.
This paper deals with final recommendations for action on each contested supergrade position coupled with a ted circling" policy to protect the incumbents of downgraded positions.
The audit reports and grade level recommendations of the contractor which performed the audits for the NRC were reviewed by the Division of Organization and Personnel.
The Division of O&P then made its recommendations to the Executive Director for Operations who in turn advised each office director.
In accordance with the Commission's directive, a Position Evaluation Review Committee (PERC) was established to hear appeals from the Division of O&P recommendations and to make independent grade-level recommendations to the EDO.
The positions appealed to PERC are listed in the following table.
The Executive Director for Operations endorses the Position Evaluation Review Committee's recomn;endations for the grade inel of each position appealed to the Committee.

28 Total 5 of these actions affecting individuals who are already in supergrade positions can be accomplished without impacting the overall number of supergrade positions.
These would be the promotions from GS-17 to 18, GS-16 to 17 and the changes to the STS pay system.
It is recommended that these promotion actions be taken imediately.
The ' remaining recommended promotion actions will require the resolution of ceiling authorization issues.
" Red Circling" Downgraded Positions Implementation of the supergrade audit requires that some positions be downgraded.
Actions have already been taken to reduce the grades of vacant positions slated for downgrading.
However, a number of presently encumbered positions are recommended for downgrading.
Commencing more than a year ago, the Civil Service Commission permitted certain agencies in the competitive service with over-grading problems to " red circle" overgraded positions for a period of time in order to give the agency (and the employee) some time to solve the problems. The term " red circle" means that the position would be properly evaluated at a lower grade than it currently possesses but that the incumbent will not be downgraded for a period of time.
The Civil Service Commission placed time limits on the agencies for solving the problems associated with red circiled positions and required controls on their filling vacancies from the outside as well as placement programs to assist the incumbents to find positions at their current grade levels.

The Civil Service Reform Act of 1978, which.has been passed by both Houses of Congress-in different f'orms and is now before a Conference Comittee, will statutorily authorize a government-wide policy of red circling overgraded positions until the present i.ncumbent vacates the position.
In view of these actions by Congress and the Civil Service Comission, it is recommended that the NRC "rrd circle" over-graded positions and permit the incumbent to retain the higher grade so long as the employee continues in the " red circled" position. When the " red circled" position is vacated, it will then be allocated at its proper grade level.
As discussed in SECY. 78-97, the three currently encumbered supergrade positions at the GS-16 level recommended for down-grading to GS-15 can be covered by the " vacancy factor" (the number of vacant supergrade positions occuring at a point in time for which recruitment actions are in process).

' Requirements for Additional Supergrade Positions It has now been determined that 238 supergrade positions are required to' meet the Agency's current and forseeable supergrade and STS needs.
This would require an increase of 28 in the Agency's ceiling from OMB.
In view of the significant increase in requirements for super-grade positions, a number of organizatiorc and position management studies have been suggested.
These studies will focus on areas where the current span of control suggests possibilities for consolidation of organizational components.
For the most part, this focuses on assistant director positions with only a few branches reporting to them.
OMB pointed out deputy and assistant positions in their 1976 supergrade study as points of position management concern.
A task force is currently being formed to study these questions.
It should be note'd that we are obligated to report the results of this supergrade. study to OMB and the appropriate oversight Comittees of the Congress.
Following Comission review, I would like to discuss with you the possible approaches to accomodate our requirements for supergrade positions.

4 Recomendation:
That the Comission approve:
(a) All proposed promotions resulting from the Supergrade Study which are possible within the current supergrade ceiling; and (b) " red circling" policy for incumbents of positions which are recomended for downgrading as a result of the Supergrade Study.
