GOVERNMENT ACCOUNTABILITY PROJECT (GAP) PETITION IN THE D.C.

CIRCUIT SEEKINO REVIEW 0F 00-87-19 (YELLOW TICKET 889044)

In a note dated March 8, 1988, from Charles E. Mullins, OGC, to Thomas E.

Murley, NRR, et al., OGC requested materials that were used by the staff in responding to a petition filed by GAP on Fermi-2 dated May 7, 1987. NRR has been informed by OGC that the assignment for this case has now been reassigned from Charles E. Mullins to Carolyn Evans.

The primary input for the response to GAP's May 7, 1987 petition was provided by Region III. NRR has discussed your request with Region III, and this memo includes the materials in Region Ill's possession. There are three categories of materials that were requested: (1) materials cited in the Director's Decision; (2) materials which may have been considered by the Director but not actually cited in the decision; and (3) any other materials which are relevant to the issues under consideration. The materials requested are enclosed in Enclosures 1 and 2. Enclosure 1 contains the materials cited in the Director's Decision and Enclosure 2 contains materials falling into the latter two categories.

NRR does not have copies of the 01 materials cited in the Director's Decision.

As discussed between Carolyn Evans and Ted Quay on March 15, 1988, it is i expected that 0! will either provide copies of those materials for OGC review or will enable OGC to review those materials at their offices.
