Dear Mr. Mueller:
The NRC issued confirmatory action letter (CAL) R!ll-97-002 on February 25,1997, which i
l formalized your commitments to take specific actions in response to the reactivity l
management event of February 21,1997. The NRC issued a supplement (Rlil-97-002A) to the CAL on April 14,1997, to encompass a broader spectrum of fundamental performance issues that are reflected in your extended shutdown decision, und to ensure more direct l
NRC involvement in the plant restart decision.
l We recognize that you and your staff are aggressively evaluating programs and processes at Zion Station, and that needed improvements will be implemented as problems are l
identified. We understand that these actions will continue as your staff proceeds to
)
l restart and operate the facility. This second supplement to the CAL is being issued to l
address several specific Zion technical issues involving equipment material condition that l
both you and the NRC believe are pertinent to a restart decision for the Zion Station. It is important that these issues be clearly defined and understood. You are expected to ensure that other technical issues pertinent to a restart decision are identified, communicated to the NRC, and adequately resolved. Future supplements to this CAL may be needed.

Pursuant to a telephone discussion on June 5,1997, between you and Mr. Geoffrey Grant, it is our understanding that you are currently pursuing resolution of the following Zion Station issues, in addition to those actions described in the original CAL and its

The previous CAL supplement specified that you will keep the NRC updated on the projected startup date to facilitate advance planning of an NRC assessment of your readiness for restart and that you would meet with the NRC once you have concluded that Zion Station is ready for restart to discuss the basis for your conclusion. Therefore, it is expected that your planning for plant startup will account for the time necessary for the NRC inspection to be conducted and you will keep the NRC appraised of associated timeframes as early as possible to facilitate inspection planning.
Nothing in this confirmatory action letter is intended to preclude you from taking actions which you deem necessary to place the plant in a safe condition or maintain it in a safe condition in the event of changing conditions.
Pursuant to Section 182 of the Atomic Energy Act,42 U.S.C. 2232, you are required to:

Notify me immediately in writing if your understanding differs from that set forth above; (2)
Notify me if for any reason you cannot complete the actions within the specified schedule and advise me in writing of your modified schedule in advance of the change: and (3)
Notify me in writing when you have completed the actions addressed in this Confirmatory Action Letter.
Issuance of this Confirmatory Action Letter does not preclude issuance of an order formalizing the above commitments or requiring other actions on the part of the licensee; nor does it preclude the NRC from taking enforcement action for violations of NRC requirements that may have prompted the issuance of this letter. In addition, failure to take the actions addressed in this Confirmatory Action Letter may resuit in enforcement action.
