Dear Mr. Chairman:
On Wednesday, October 23, an expurgated version of the enclosed report and related materials was hand delivered to Mr. Peter Stockton of the Subcomittee staff at his request.
This information concerns an investigation of the regulatory performance of NRC's Region II Office as it relates to the Grand Gulf nuclear power station.
The enurgated version originated as a result of the Comission's review to determine what information should be released under the Freedom of Information Act (F0!A).
Deleted from this version are the names of non-executive personnel whose cooperation was key to achieving the investigation results. Some of these individuals have neither the expectation nor the desire to find their identities spotlighted.
In performing the F0IA review, it was decided that it was not inconsistent with other dictates of the public interest to give consideration to the privacy interests of these individuals.
In addition, the F0IA review determined that certain portions of predecisional advice provided to the Comission by its Office of Inspector and Auditor should be withheld. We believe that release of these opinions and recomendations would be detrimental to the quality of the agency's decisional process.
Release of such material would hinder the Comission's ability in the future to receive frank and candid opinions and recomendations from its entployees.
At the request of your staff, we are forwarding the unexpurgated version to you. For the reasons stated above, the Comission requests that you preserve the confidentiality of the unexpurgated version and restrict its use to the Members and staff of the Subcomittee.
