REQUEST NDE SERVICE WATER SYSTEM (SWS) LEAKS (TAC NOS. M97896 l AND M97897) l l

Dear Mr. O'Hanlon:

l The NRC staff has evaluated the information provided in ycur February 3,1997, i' submittal related to the inservice inspection program relief request No.

NDE-31.

Based on the evaluation of relief request NDE-31, we conclude that the immediate Code repair during the period October 31, 1996, through December 14, 1996, would have constituted an undue burden on VEPCO, since in order to '

perform Code repairs, the "A" SW header would have required removal from service. Since the "B" header was already out of service.during this time for piping upgrades, taking both SW headers out of service to perform Code repair would have required both units to be shut down.

Alternatives to Code requirements may be used by licensees when authorized by the Director of the Office of Nuclear Reactor Regulation if the proposed  ;

alternatives to the requirements are such that they are shown to provide an '

acceptable level of quality and safety in lieu of the Code requirements  ;

[10 CFR 50.55a(a)(3)(1)], or puruant to 10 CFR 50.55a(a)(3)(ii), if' compliance with the Code requirements would result in hardshipor unusual difficulty i

without a compensating increase in the level of quality and safety.

Your alternative program for this period included evaluation of the flaws which are consistent with the guidelines and acceptance criteria of GL 90-05.

The staff finds the structural integrity and operability assessments to be -

acceptable. You have stated that during the period of October 31 through December 14, 1996, the welds were monitored by plant personnel and all the flaws were repaired by December 14, 1996. In addition, you had evaluated the defective areas and determined that the flaws were acceptable and the SWS was determined to be operable.

Therefore, the relief is granted pursuant to the provisions of 10 CFR I 50.55a(g)(6)(1). The granting of this relief is authorized by law and will  ;

not endanger life or property or the common defense and security and is )

otherwise in the public interest giving due consideration to the burden upon VEPC0 that could result if the requirements were imposed on the facility. The i staff's evaluation and conclusions are contained in the Enclosure. j The staff has completed its evaluation of this matter and we are, therefore, closing out TAC NOS. M97896 and M97897.
