Dear Mr. Klein:

We have completed our review of the WasteChem Topical Report, VRS-002, "10 CFR 61 Waste Form Conformance Program for Solidified Process Waste Products Produced by a Wastechem Corporation Volume Reduction and Solidification (VRS) l' System," dated August 1987. We find the report, as modified to include the g

information supplied in response to staff questions and comments, will serve as an acceptable reference concerning WasteChem's bituminization process for low-level radioactive waste.

We also find that there is reasonable assurance that waste forms produced according to the process described in the report will satisfy the structural stability requirements of 10 CFR Part 61 based on the criteria of the 1983 Technical Position on Waste Form. The enclosed evaluation defines the basis for our findings.

In accordance with procedures established in NUREG-0390, we request that WasteChem publish accepted versions of the Topical Report, proprietary and non-proprietary, within 3 months of receipt of this letter. The accepted versions shall incorporate this letter and the enclosed Technical Evaluation Report (TER) between the title page and the abstract. The accepted versions shall conclude an "A" (designating accepted) following the report identification symbol.

Should our criteria or regulations change, so that our conc'iusions concerning the acceptability of the report and WasteChem's bituminization process are invalidated, Wastechem and/or the users referencing the topical report will be expected to revise and submit their respective documentation, (including the submittal of additional data or analysis), or submit justification for the continued applicability and acceptability of the topical report and waste S$$ %D2a 9

forms without revising their respective documentation. As you are aware, we currently require backfilling around bitume:i waste forms. Please note that in this regard, and in respect to potential new criteria, we are studying the advisability of recomending that the bituminized waste forms should be demonstrated to have sufficiently high viscosity to preclude infiltration into the backfili material.
