This refers to the prelicensing inspection by Ms. Jean M. Dawson at your facility in Midland, Texas on October 17, 1978 and her discussion with Mr. Richard Turner, and to the telephone conversation on October 20, ;978 between Ms. Dawson and Tom Hansen.
It was determined that you are currently using licensable material at locations in Oklahoma, a state where the U. S. Nuclear Regulatory Commission has jurisdiction. With regard to this matter, you are informed that:
(1) a ' specific license or_ a general license from the NRC is required for use of the licensable material in states where the NRC has jurisdiction, and although you have applied for an NRC license, use of material is not permissible until such time as the license is issued; and (2) that a general license recognizing your Agreement State license can be authorized pursuant to 10 CFR 150.20, " Recognition of Agreement State Licenses,"
providing that all of the requirements of this section are met.
As a result of our telephone conversations on October 20, consistent with 10 CFR 150.20(1), we have authorized you to comence an activity and we understand that you will submit to this office the documentation required by 10 CFR 150.20 and conform to all other requirements of thir section if licensable material is used in the absence of a specific NRC license.
