UNAUTHORIZED POSSESSION OF BYPRODUCT MATERIAL i
Dear Mr. Feitetson:
4 This letter refers to your possession of regulated byproduct material without a proper NRC license. The byproduct material consisted of approximately 15 millicuries of nickel-63 in each of two electron capture detectors (ECDs), each in a separate gas chromatograph (GC).
During a telephone discussion between Mr. Subash Rashat of Hera Tech Environmental Lab (Hera Tech) and Mr. Steven Courtemanche of this office, Mr.
Rashat stated that he transferred the above byproduct material to you about January 8,1997. On January 15,1997, you stated to Mr. Courtemanche that you did not possess a specific NRC license to receive the byproduct material, but that you had a general license for the possession of Perkin-Elmer GCs. Mr. Courtemanche informed you that until you registered the GC that you received from Hera Tech with the Perkin-Elmer Company, the general license did not extend to the above GC. Also, the Tracor GC required a specific NRC license or could be converted to the generally-licensed device of the manufacturer by means of a kit. 10 CFR 30.3 provides, with exceptions not applicable in this case, that no person shall possess byproduct material except es authorized in a specific or general license.
Based on the results of these telephone discussions, it appears that your activities were not conducted in full compliance with NRC requirements. A Notice of Violation is enclosed and categorizes the violation by severity levelin accordance with " General Statement of Policy and Procedure for NRC Enforcement Actions," (Enforcement Policy), NUREG 1600. The NRC has concluded that information regarding the reason for the violation, your corrective actions, and your actions to prevent recurrence is.

Therefore, you are not required to respond to this letter unless the description described above does not accurately reflect your actions or your position. In that case, or if you choose to provide additional information, you should follow the instructions specified in the enclosed Notice. You should pay meticulous attention to NRC regulations and requirements in the conduct of licensed activities in the future.
In accordance with 10 CFR 2.790, a copy of this letter will be placed in the NRC Public Document Room.
