This is in further response to Mr. Foley's letter of March 8,1978, in
which he requested, pursuant to the Freedom of Information Act, access
to NRC's Inspection and Enforcement report numbers 50-245/77-29 and 50-
'
336/77-28 and the accompanying notice of violation relating to security
problems at the Mills. tone Nuclear Power Station.
In Mr. Donoghue's letter of April 21, 1978, he indicated that the
licensee considered documents 3 and 4 of Appendix A as commercial or
financial information pursuant to 10 CFR 2.790(d), and the documents
were withheld pursuant to Exemption (4) of the Freedom of Information
Act (5 U.S.C. 552(b)(4)) and 10 CFR 9.5(a)(4) of the Commission's
regulations.
Mr. Donoghue also informed you that if it was subsequently
determined that documents or any portions thereof could be released, we
would let you know.
The NRC has now determined that portions of these documents may be
released and copies of the documents are enclosed.
The deleted portions
of the documents continue to be exempt from disclosure.
