SUBJECT:

NOTICE OF VIOLATION This. refers to'the telephone discussion between Mr. D. B. Spitzberg of this office and Mr. Doyle Primm of your organization on March 7,1988.

The subject of the discussion was information we received concerning radioactive sealed sources in your possession which you obtained by repossessing certain assets of your debtor client, Nueces Inspection Company of Corpus Christi, Texas.

During the conversation, you confirmed the possession of two 1.5 curie and two 10 curie cesium-137 sealed sources contained in shielded housings on well casing inspection equipment located at your facility in Oklahoma City.

Your possession of that material without a valid, specific license is a violation of Section 30.3, 10 CFR Part 30.

Section 30.3 requires:

Section 30.3 Activities requiring license.

Except for persons exempt as provided in this part and Part 150 of this chapter, no person shall manufacture, produce, transfer, receive, acquire, own, possess, or use byproduct material except as authorized in a specific or general license issued pursuant to the regulations in this chapter.

-This Notice of Violation is sent to you under the prcvisions of Section 2.201 of the NRC's "Rules of Practice," Part 2, Title 10, Code of Federal Regulations.

Section 2.201 requires you to submit a written reply to this Notice explaining the steps you have taken to correct this situation.

In accordance with the information conveyed to us in the telephone discussion, we understand that you will divest yourself of the material immediately, in a lawful manner.

In your reply to this Notice include a statement which explains the method of disposal of the materials, including: what material was involved, how it was disposed of or to whom it was shipped, and when this was done.

Your reply to this Notice of Violation shall be sent, within 30 days of the receipt of this letter, to Region IV, U. S. Nuclear Regulatory Commission, 611 Ryan Plaza Dr., Suite 1000, Arlington, Texas 76011, Attention: William L.

Fisher, Chief, Nuclear Materials and Emergency Preparedness Branch.
