The NRC Region I duty officer received an allegation on February 4,1994 regarding the i questionable fitness for duty of a contract HP at I er l indicated that an individual nam w-(i The Region I duty officer transferred the information he initially received to Dan Holody, Region I Enforcement Officer, who called th ack in an attempt to gain more information. Because of the reference ext possible duty station (St. Lucie),

. Mr. Holody faxed this information to Bruno e of on February 4,1994. After initial review of the reference to Salem, Region I concluded that the informa' tion provided was not specific enough to warrant further investigation. Because of the reference to pending employment at St. Lucie, I am forwarding a copy of Allegation File RI-94-A-0022 for your review and use. Because of the reference to South Texas, I am also forwarding a copy of the file to Region IV for their information. By copy of this memorandum, I am closing the Region I file.

SAC phoned the ALGR to ascertain the scope, details and confimation of his concern regarding discriminatory employment practices by Florida Power and Light Company. The ALGR saW that he has worked for FP&L approximately De ghtee yearM The ALGR said that

and has accused them of openly discriminating against him for reporting nuclear safety concerns. The ALGR was well aware of the DOL reporting requirements and the

information contained on the NRC Form 3 and said that he intends on filing a

! discrimination compliant with the Department of Labor. SAC informed the ALGR that SAC would send him a certified letter the following day (March 3,1995) to acknowledge our conversation and provide him with information on filing a DOL complaint and the NRC policy on identity protection. The ALGR reiterated that it is well known that he is

accusing the licensee of discrimination and that he is in contact with the NRC or will be in contact with the NRC.

l l l' . l \ d% l ENCLOSURE 1 l lDENTITY PROTECTION l 1 This is important information concerning Nuclear Regulat~ory Commission l (NRC) procedures for protection of the personal identity of individuals l providing information and/or' concerns to the NRC. The NRC will take all l reasonable precautionary measures not to disclose an individual's identity , j to any organization, individual outside the NRC, or the public. 1 j However, an individual who provides information to the NRC should be aware j that his/her identity can be disclosed outside the NRC if the disclosure is I necessary to ensure public health and safety, or to inform Congress or l State or Federal agencies in furtherance of NRC responsibilities under law l or public trust. The NRC also may disclose an individual's identity to other organizations, persons outside the NRC, or to the public if the individual clearly indicates that he/she has no objection to being l identified as the source of the information. The NRC will not consider an individual as a confidential source unless confidentiality has been formally granted in writing.  ! i l Individuals also should be aware that if the concern relates to harassment and intimidation, their identity will be disclosed during any subsequent NRC investigation of the concern because an effective investigation can not i be undertaken without revealing the individual's identity. In addition, if the concerns relate to wrongdoing, the identity of the individual providing j the concern) could be disclosed at the NRC's discretion in order to pursue l the investigation of that matter. l l The NRC will make every effort to handle this matter in such a way as to I maintain the protection of an individual's identity. NRC procedures to ensure this include limiting access to documents which contain an individual's identity, preparing documentation in such a way as to conceal the identity and other internal control procedures which limit the dissemination of an individual's identity on a strict need-to-know basis. Individuals should be aware, however, that licensees can and do sometimes I l correctly guess the identity of individuals who provide information to the i l NRC because of the nature of the information or other factors beyond our  ! l control. In such cases, our policy is to neither confirm nor deny the  ; l accuracy of their guesses. l The NRC will not take precautionary measures to protect an individual's identity if the individual takes actions that are inconsistent with and  ; override the purpose of protecting identity.
