. GE Nuclear Energy 175 Curtner Avenue San Jose, CA 95125 Gentlemen:
Your letter dated September 29,1987 (MFN #100-87), to Mr. Thomas Murley of the Office of Nuclear Reactor Regulation applied for Design Certification of the Advanced Boiling Water Reactor standard plant.
In addition, your letter requested exemption from the current fee requirements of 10 CFR 170 in the form of a deferral cf both the application and review fees as set forth in the Comission's decision of March 5, 1987.
This letter is to inform you that as a result of the Comission's decision of March 5, 1987, application and review fees for standardized design approvals and certifications will not be imposed in accordance with the current provisions of 10 CFR 170.
Fees for prelininary and final design approvals will be recovered in 20 percent increments as the design is referenced. However, whether referenced or not, full costs will be recovered by the NRC from the holder of the design approval within five years of tne design approval (preliminary and final). The five year period will be extended to ten years if the design is certified.
If the application is denied, withdrawn, suspended, or action on the application is postponed, fees will be collected when the review, to that point, is completed and the five installment payment procedure will not apply.
The above changes to 10 CFR 170 will be addressed in the next revision issued to the regulations.
