Dear Mr. Wukasch:

This is to confirm the comments and suggestions made to you by E. C. Ashley and L. A. Bolling following the completion of the recent regulatory review of the Texas radiation control program and the discussion by J. F. Kendig following his review of compliance files and uranium mill license files.

Enclosed is a copy of our letter to Dr. Duff in which we advise that the staff believes the Texas radiation control program is adequate to protect the public health and safety and is compatible with the program of the NRC and of the Agreement States.

In addition to reviewing two insitu uranium license files the reviewer was asked to look over and comment on a new application for a license for an insitu uranium operation, Mobil Oil Corporation, Nell Uranium Project.

The reviewer conducted a content review and then briefed the staff of his findings on this application as well as the two licenses referred to above.

The reviewer infonned the staff that a typed outline of items to consider in a licensing. action for an insitu uranium operation would be provided at a later date. Copies of NRC licenses for iiisitu and heap leach operations were provided to the staff as examples.

Based on the review of the licensing and compliance aspects of the program, comments and recommendations were developed to enable improvements in these areas (enclosure). I would appreciate knowing of your plans for implementing these reconmendations. .

I appreciate the courtesy and cooperation extended to Messrs. Bolling, Kendig and Ashley by you and your staff.

Comments and Recommendations on the Texas Radiation Control Program

1. Licensing, Comment and Recommendation During our review of two completed device evaluations it was noted that the information submitted by the manufacturers was not complete.

We recommend that manufacturers be required to furnish to the agency results of prototype tests and information on quality control for each device to be evaluated.

2. Compliance
a. Comment and Recommendation At the present time survey meters used by the inspection staff are being calibratsd on an annual basis. We recommend that survey instruments used for independent measurements be calibrated at

_ frequencies no greater than those required of licenses.

b. Comment and Reconmendation Enforcement letters do not request licensees to describe the steps which will be taken to prevent a reoccurrence of the item (s) of noncompliance. We believe such a description will strengthen the licensee's management control program.
c. Comment and Recommendatien Inspection reports do not indicate whether or not an examination is made as to the status of previous items of noncompliance. During reinspections of licensees who were cited for violations in the previous inspection, we believe the inspector should confirm that corrective actions described in the licensee's reply to your enforcement letter were taken and that the actions were adequate.

In this respect, enclosed is an inspection report form for radiography inspections used effectively by another Agreement State. You may wish to use this in reviewing your draft inspection repc t forms prior to their becoming final.
