APPENDIX A NOTICE OF VIOLATION Northeast Nuclear Energy Company Docket No. 50-423 Millstone Unit 3 License No. NPF-49 During NRC inspection.from January 20 to February 22, 1988, a violation of NRC requirements was identified. 'In accordance with the "General Statement of Policy and Procedure for NRC Enforcement Actions," 10 CFR Part 2, Appendix C, that viola-tion is listed below: '
Technical Specification 3.5.2 requires that two independent safety-related charging pumps be operable in Mode 3. . Technical Specification 3.0.4 does not allow changing modes unless the Limiting Conditions for Operation are met without reliance on action statements.
Contrary to the above, at 5:42 p.m. , January 29, 1988, the plant was taken from Mode 4 to Mode 3 with only one,of the two required charging pumps oper-able. The "A" charging pemp was inoperable until about 8:20 a.m., January 30, 1988 because its cooling water inlet and valves for the lubricating oil heat exchanger were closed.
This is a Severity Level IV Violation (Supplement I).
Pursuant to 10 CFR 2.201, Northeast Nuclear Energy Company is required to submit to this office, within 30 days of the date of the letter trans. mitt'ng this Notice, a written reply including: (1) the corrective steps which have becn taken and the results achieved, (2) the corrective steps which will be taken to avoid further violations, and (3) the date when full compliance will be achieved. Where good cause is shown, consideration will be given to extending the response time.
