This is to inform you, in accordance with the requirements of the Nuclear Non-Proliferation Act, that NRC has not completed licensing action on your export application XSNM00937 for high-enriched uranium for Use in the Japan Material Testing Reactor.
Although Executive Branch views were received on June 28, 1978, final NRC licensing action has been delayed for several reasons.
Your application has been subjected to careful review by both the Executive Branch and the NRC in view of U.S. Government policy to limit exports of highly enriched uranium to only those with a clear economic and technical justification.
We also requested supplementary information regarding physical security arrangements for the material.
Your September 14 request to add a new inter-mediate consignee has also delayed licensing action.
Your application was forwarded to the Commissioners on September 8 where it had been held pending receipt of the required government assurances concerning the new intermediate consignee.
These assurances were received on October 17 and forwarded to the Commissioners on October 19.
We expect a decision from the Commissioners very soon.
