Subject:

PROPOSED IMPOSITION OF CIVIL PENALTY - $75,000 This is to inform the Commission that a Notice of Violation and Proposed Imposition of Civil Penalty in the amount of Seventy Five Thousand Dollars

($75,000) will be issued on or about January 19, 1988 to Omaha Public Power District. This action is based on the failure to lock the door to a very high radiation area and the failure to follow the health physics procedures and technical specifications when enterina a very high radiation area.

Subsequent to the inspection, two additional violations were identified. These included a second unlocked very high radiation area door and the failure to issue a Licensee Event Report for the initial unlocked very hiah radiation area door. The escalation and mitiaation factors in the Enforcement Policy were considered and the base civil penalty amount has been increased by 50%

because of a prior similar violation in May 1986.

It should be noted that the licensee has not been specifically informed of the l enforcerrent action. The schedule of issuance and notification is:

Mailing of Notice January 19, 1988 Telephone Notification of Licensee January 19, 1988 The State of Nebraska will be notified.

The licensee has thirty days from the date of the Notice in which to respond.

Following NRC evaluation of the response, the civil penalty may be remitted, mitigated, or imposed by Order.
