SUBJECT:
COMMENTS ON WHITE PAPER ON DOE OVERSIGHT BY NRC 4
l We have reviewed the draft white paper, " External Regulation of DOE Facilities," which is attached to Commissioner Diaz' memorandum dated March 13, 1997.
In summary, the paper pulls together some information on some U.S. Department of Energy (DOE) facilities. The Commissioner's transmittal memorandum suggests a U.S. Nuclear Regulatory Commission pilot program of i
oversight of "other (DOE] laboratories" such as the Fermi Lab, and suggests asking the staff for a quick estimate of resources needed to conduct the pilot program. At the same time, the Commission is considering a Staff Requirements Memorandum (SRM) associated with DSI (Direction Setting Issue) 2, on the subject of oversight of DOE facilities. That SRM would call for an 1
interoffice task force. The strategy and plans for recommending how the NRC should proceed will be generated by the task force.
This will include l
consideration of any trial program and associated resources for oversight of DOE facilities.
We suggest that additional homework and analyses are needed d
before recommending a pilot program (e.g,, Is NRC authorized to engage in a pilot program of oversight of accelerators? What is the base condition of the labs and what is the standard to compare to? How does one develop expertise on accelerators, if necessary?).
Because NRC does not have information on the design and operation of these facilities, we can not make a meaningful resource estimate for oversight of the identified labs at this time.
On a very rough basis, maybe 10 to 20 FTE per year and around $2 million of contractor assistance would suffice.
I suggest the task force take into 4
account the white paper in preparing its recommendations to the Commission, in response to the SRM on DSI 2.
