Enclesed are background documents pertaining to the Indian Point 3 steam generator replacerent program. Enclosure 1 is a brief sumary of the licensee's positier or why the replacement can ha accomplished under 10 CFR 50.59 (Enclosure 5 provides the licensee's detailed presenu: tion to the NRC in a meeting on July 30, 1987).

Enc'esure 2 presents a brief sumary of the positions taken on this matter by the principal NRC staff organizations. is a copy of the memorandue by CEST stating a position recomending review by the staff. Enclosure 4 is a copy of Generic letter 84-07, "Procedural Guidance for Pipe Replacerent at BW:s,"

which gives guidance for replacing BWR pipes under 10 CFR 50.59 which is corparable to this project.

I hereby request, pursuant to the federal Freedom of Information Act, 5 U.S.C.

5552, ar, amended, copies of all records (as that term is defined in 10 C.F.R. Part 9) con-taining the following information:

All information which explains, clarifies or interprets the phrase "unreviewed safety question."

This phrase is defined in 10 C.F.R. 550. 59 (c) with the following language:

(i) if the probability of occurrence or the consequences of an accident or malfunctjon of equipment important to safety previously evaluated in the safety analysis report may be increased; or (ii) if a possibility for an accident or malfunc-tion of a different type than any evaluated pre-viously in the safety analysis report may be created; or (iii) if the margin of safety as defined in the basis for any technical specifi-cation is reduced.

By way of example, I am especially interested in guidance prepared by the NRC Staff, the Executive Director of Operations or 'he NRC Office of General Counsel.

I am not interested in relemaking notices from the Federal Register or interpretations contained in inspection reports or notices of violation.
