REQUEST FOR WITHHOLDING INFORMATION FROM PUBLIC DISCLOSURE By letters dated January 10, June 14 and June 15, 1978, you su bitted responses to our requests for additional information resulting trom our review of " Topical Report RWR-lTM Radwaste Volume Reduction System",

EI/NNI-77-7-P. You requested that this information be withheld from public disclosure pursuant to 10 CFR 2.790. Your submittals also in-cluded an affidavit to support this request. Subsequently, in response to our letter dated October 12, 1978, regarding withholding this infor-mation, you responded on November 10 and December 4,1978, reiterating your request for withholding the information from public disclosure and providing a non-proprietary version of the information.

Your reasons for requesting our withholding of this information are that it contains detailed or specific process data relating to the design and operation of your radwaste system and that the information is not known to be available in public sources.

We have reviewed your application and material based on the requirements and criteria of 10 CFR 2.790 and have determined that the above-mentioned documents sought to be withheld contain trade secrets or canfidential or proprietary conmercial or financial information.

We also have found at this time that the right of the public to be fully apprised as to the bases for and effects of the proposed action does not outweigh the demonstrated concern for protection of your competitive position. Accordingly, we have determined that the information should be withheld from public disclosure.

We therefore approve your request for withholding pursuart to Section 2.790 of 10 CFR Part 2 and are withholding the documents transmitted by the January 10, June 14 and 15 letters from public inspection as pro-

- prietary.

Mr. J. R. May LE: 1 . M 3 Withholding from public inspection shall not affect the right, if any, of persons properly and directly concerned to inspect the documents.

If the need arises, we may send copies of this information to our con-sultants working in this area. We will, of course, assure that the consultants have signed the appropriate agreements for handling pro-prietary data.

If the basis for withholding this information from public inspection should change in the future such that the information could then be made available for public inspection, you should promptly notify the NRC.
