APPENDIX A NOTICE OF VIOLATION

. Westinghouse Electric Corporation License No.: Sh3-1107 Based on the results of the.h7C inspection conducted on August 30 -

September 1, 1978,.it appears-that certain of your activities were not conducted in full compliance with NRC regulations and License Cooditions as indicated below. These items have been categorized as described in our correspondence to you dated December 31, 1974.

License Condition 3.1 requires that the licensee or his designated agent shall measure, except as specified in 10 CFR 70.58(e), and conditions 3.2, 3.3 and 3.4, the uranium and U-235 content of all Sh3 receipts, shipments, vaste discards and material inventoried including all LT6 receipts.

Contrary to the above, low level uranium liquid volumes discharged through the On-Line Monitor during the period June 5 through July 2, 1978, were overstated by 41l510 gallons or approximately 3367 grams of low enriched uranium.

This is a deficiency.

The Code of Federal Regulations, 10 CFR-70.32(c)(2), requires ,

that the licensee furnish the Commission a report containing a description of the change to the material control and accounting program within six months of the change if it pertains to uranium enriched less than 20 percent in the U-235 isotope.

Contrary to the above, the licensee made a change to his material control and accounting program on July 1977 and failed to notify the NRC within six months of the change.

This is a deficiency.
