APPROVAL UNDER SECTION 145b. OF THE ATOMIC ENERGY ACT OF' 1954, AS AMENDED, FOR THE EMPLOYMENT OF VANDY L. MILLER Issue: The Director, Office of Nuclear Material Safety and Safeguards (NMSS), has requested Commission approval to employ Mr. Vandy L. Miller as Chief, License Management Branch, NMSS, before his security investigation is completed and evaluated. Enclosure 1 is Mr. Miller's Personal Qualifications Statement.

Discussion: The nirector, NMSS, has certified that a serious delay ir. tne operation of the Radioisotopes Licensing program will result unless Mr. Miller is employed by NRC prior to completion of the normal authorization procedures (seeEnclosure2).

Mr. Miller is a Colonel in the United States Army. He is currently assigned to Headquarters, Department of the Army, Office of the Surgeon General. Reportedly, Mr. Miller holds a Top Secret clearance based on a back-ground investigation conducted by the Army in July 1969.

Notwithstanding this, however, neither the Army nor the Department of Defense investigative records repository has been able to locate a record of any investigation of Mr. Miller.

The Personnel Security Questionnaire of Mr. Miller has been favorably reviewed. Additionally, the Federal Bureau of Investigation, which is currently conducting -

the required investigation, advised that name and fin-gerprint checks already conducted on Mr. Miller revealed no derogatory information. Similarly, preemployment checks conducted by the Division- of Organization and Personnel on Mr. Miller revealed no derogatory information.

Reconmendation: The Commission:

1. Determine pursuant to Section 145b. of the Atomic Energy Act of 1954, as amended, that the employment by NRC of Mr. Miller is clearly consistent with the national interest.
2. Determine that Mr. Miller be precluded through ad-ministrative procedures from having any access to National Security Information or Restricted Data pending completion of the investigation currently being conducted and a favorable determination as to his eligibility for a security clearance.

Coordination: The Office of Nuclear Material Safety and Safeguards concurs in and the Executive Legal Director, the Division of Organization and Personnel, and the Division of Security have no objection to the recommendations contained in this paper.

Commission Staff Office comments, if any , should be submitted to the Commissioners NLT November 30, 1978, with an information copy to the Office of the Secretary. If the paper is of such a nature that it requires additional time for analytical review and comment, the Commissioners and the Secretariat should be apprised of when comments may be expected.

This paper is tentatively scheduled for affirmation at an Open Meeting during the Week of December 11, 1978. Please refer to the appropriate Weekly Commission Schedule, when published, for a specific date and time.
