Dear Mr. Kenyon:

On September 26, 1996, Northeast Nuclear Energy Company (NNECO) informed the NRC, pursuant to 10 CFR 50.72(b)(2)(iii)(D), that they had identified 21 safety-related air operated valves that are controlled by solenoid operated pilot valves, which do not receive Class _1E power. NNECO followed up the t

event notification with License Event Report 96-036-00, dated October 25, 1996.

The NRC staff has completed a preliminary review of this event and has identified several issues that require additional information.

i MILLSTONE LMIT 3 D0CKET NO. 50-423 On September 26, 1996, Northeast Nuclear Energy Company (NNECO) informed the NRC, pursuant to 10 CFR 50.72(b)(2)(iii)(D), that tiey had identified 21 safety-related air operated valves (A0Vs) that are controlled by solenoid operated pilot valves (SOVs), which do not receive Class IE power. The 21 i

SOV/A0V control switches, whose failure could affect safety system capability, l

were not included in the Millstone Unit 3 quality assurance program (i.e.,

1 they were not-Q-listed). The initial design (and subsequent modifications to the design) of the 50V/A0V control switch circuits (including administrative control) may not have been subject to appropriate design control measures.

l Thus, the initial and/or the current design for the non-Q-listed SOV/A0V control switch circuits may not meet Millstone Unit 3 licensing basis i

requirements.

In order to establish safety significance, the licensing basis i

requirements and extent of current compliance must be established for the subject SOV/A0V control switch circuit design. Thus, the staff requests a licensee-response to the following questions:

With respect to omtrol switch circuits associated with the safety j

related SOVs/A0Vs located in redundant safety systems, which were identified in the September 26, 1996, event notification as not i

receiving Class IE power and not Q-listed, the licensing basis for Millstone Unit 3 (position C.3 of Regulatory Guide 1.53) requires single j

switches supplying signals to redundant safety equipment to be designed with at least 6-inch separations or with suitable barriers between redundant circuits. For those control switch circuits associated with

]

redundant safety systems, describe to what extent these circuits j

(current as-installed design configurations) meet this 6-inch or barrier j

licensing basis requirement.

For control switch circuits associated with the safety-related 50Vs/A0Vs incated in single non-redundant safety systems, which were identified in i

the September 26, 1996, event notification as not receiving Class IE j

power and not Q-listed, describe the design provisions (i.e., the Millstone licensing basis) that ensures that no single failure in the control circuit to the single or non-redundant safety systems (including the circuits power supply) can cause loss of safety system function.

Describe to what extent these circuits (current as-installed design i

i configuration) meet this (to be described) Millstone licensing basis.

With respect to the power supply for control switch circuits associated with the safety-related SOVs/A0Vs located in redundant safety cystems, i

which were identified in the September 26, 1996, event notification as 1

not receiving Class IE power and not Q-listed, it appears, based on information available, that the licensing basis for Millstone Unit 3 i

requires an open control switch and administrative controls for assuring j

the switch is maintained in the open position. Confirm that an open a

In addition, describe to what extent switches have been maintained in their open position. Or, if applicable, describe to what extent the power supply, as an installed design configuration, meets the licensing basis (to be described if applicable) for assuring single failure of common power supplies to redundant safety systems will not cause loss of safety function.
