ORDER In our order of October 19, 1978 we noted that the Commission would decide whether to hear oral presentations in this proceeding after reviewing participants' written comments on the Hearing Board's recom-mendations.

We have received nine comments, including those of the URC staff.

Several comments were sharply critical of the Board's recommenda-tions.

Except for the State of New York, all parties commenting criti-cally also requested to address the Commission.

New York offered to speak if asked by the Commission.

Commenters who generally supported the Board's recommendations, including the NRC staff, did not request oral presentation but asked to speak in support of the Board if oral proceedings are held.

2 Based on these expressions of interest, the Commission has deter-mined to hear oral presentations, beginning at 9:15 A.fi. on January 19, 1979 in the Commissioners' Conference Room at 1717 H Street, N.W.,

Washington, D.C.

Twenty minutes each will be allote.sd for presentations by the nine commenters, to be heard in the following order:

Mr. liarvin Lewis, the Natural Resources Defense Council, the Sierra Club, the State of New York, the States of Ohio and Wisconsin, Baltimore Gas and Electric, e_t, a_1_., Commonwealth Edison, e_,t, a1,., the Tennessee Valley Authority, and t

designated commenter.

Participants may use all or any part of the time allotted.

Brief rebuttal statements may be allowed at the Commission's discretion.

The order of presentation reflects the Commission's intention that parties who opposed the Hearing Board's recommendations should speak first, followed by those supporting the Board, and then the NRC staff.

Subject to this general intention, however, parties may propose rearrange-ments in the order of speaking.

While New York did offer to respond to Commission questions at an oral hearing, New York State did not request time for an oral presentation.

Although TVA opposed oral presentations, it was unclear to us whether TVA wanted to participate at an oral hearing in the event one was held.

By this order we invite participation by TVA and New York, should they choose to attend.
