APPLICANTS' RESPONSE TO NEW ENGLAND COALITION ON NUCLEAR POLLUTION'S REQUEST FOR ENTRY UPON LAND On February 19, 1988 New England Coalition on Nuclear Pollution ("NECNP") filed a request that Applicants permit NECNP's counsel and experts to inspect and take notes, samples and photographs at Seabrook Station.

Applicants object to this request on the grounds that it is untimely filed.

On December 2, 1987 this Board issued a scheduling order regarding discovery concerning the remanded NECNP contentions I.V. and IV. "Order (Denying NECNP Motion For Extension; Rescheduling)".

In that order the Board extended the original discovery schedule which required that discovery be 8803040000 880226 PDR ADOCK 05000443 4

i completed by December 28, 1987.

The Board then stated that "Applicants, NECNP and the Staff shall proceed with discovery upon the two remanded issues and comolete discovery by February 19, 1988." Id. at 2-3 (emphasis added).

There is no apparent reason, other than delay, why NECNP wanted until the final day of discovery to file a request for entry upon the land.

Fulfillment of such a request would extend the discovery deadline well past February 19th in violation of the Board's scheduling order.

Therefore, NECNP's request should be denied.
