Dear Mr. Dattilo:

By letter dated September 11, 1978, you have requested the Licensing Board to take certain actions based on an unspecified public announce-ment by the Applicants that an increase in the storage capacity of the Marble Hill spent fuel pool was being contemplated.

As we have discussed, with the exception of the radon question, flRC hearing boards have no present jurisdiction over this proceeding.

Beyond that, the concern expressed in your letter is at best premature.

For these reasons, the Staff is not burdening the Licensing Board with a formal response to your informal letter.

The construction permits authorize the Applicants to construct a spent fuel pool in accordance with the design specified in Section 9.1 of the Preliminary Safety Analysis Report. As described, there will be capacity to store a total of one and two-thirds cores of spent fuel (approximately 340 spent fuel assemblies).

If in the future the Applicants desire to change the design of the spent fuel pool to increase naterially the capacity to store spent fuel, authorization will have to be obtained in advance f rom the HRC.

It is possible that the Applicants might choose to make such a request as part of their request for operating licenses.

Advance notice of NRC considera-tion of either request will be given to nembers of the public.

I have requested the T1RC Staff to send copies of ony future Federal Reqicter notices involving the lbrble Hill spent fuel pool or consideration of operating licenses for Marble Hill directly to you as Courisel for Save the Valley ;Save Marbl.e Hill.
