Gentlemen:

On September 7, 1978, Carolina addressed a letter to " persons interested in Part 70 Hearing on Nuclear Material License No.;5NK 1773." The letter stated that CESG represents persons concerned with the environmental effects of nuclear stations in the Charlotte (Mecklenburg), North Carolina, and the Rock Hill (York County), South Carolina areas. The letter also stated, among othe things, that transportation of spent nuclear fuel from the Oconee facility to the McGuire facility through Charlotte is an environmental hazard which threatens the health and safety of CESG members by increasing the radiation dosage to the population.

The letter appears to be an attempt to supplement the CESG " Motion to Reopen Environmental Hearing to Add Contention (2)" May 23,1978, which is being treated as a petition to intervene in Docket No. 70-2623 (the McGuire/0conee spent nuclear fuel transportation proceeding) pursuant to the notice of opportunity for hearing published on July 28, 1978.

43 Fed. Reg. 32905. Sections 2.714(a)(3) and 2.714(b) [10 C.F.R. 552.714 (a)(3) and s2.714(b)] permit pertitions to be supplemented without cause until fifteer. (15) before a scheduled prehearing conference. On September 22, 1978 the Licensing Board set a special pre-hearing conference for October 24, 1978.

As appropriate, the NRC Staff will consider the comments made by CESG in its letter of September 7,1978 in following the procedure specified by 10 CFR s2.714.
