Dear Mr. Knuth:

This is 'in further response to your letter dated October 5,1978, in which you requested, pursuant to the Freedom of Information Act, access to all documents used by the Commission in its deliberation in establishing

the threat level of 10 CFR Part 73.55(a) or those subsequent documents j

which may be a basis for confirming or modifying this threat level.

In further response to your request the documents listed in Appendix A.

are being placed in the NRC Public Document Room (PDR), located at 1717 H Street, N.W., Washington, DC.

Access can be obtained by requesting PDR F0IA Folders77-239, "S. Turner", and 77-A-50, "K. Gaynor".

Portions of document 1 of Appendix B have been classified pursuant to Executive Order 11652 and continue to be classified pursuant to Executive Order 12065 and are being withheld from public disclosure pursuant to exemption (1) of the Freedom of Information Act.(5 U.S.C. 552(b)(1)) and 10 CFR 9.5 (a)(1) of the Commission's regulations.

Document 1 of Appendix B with exempt portions deleted is also located in PDR F0IA Folders77-239, "S. Turner", and 77-A-50, "K. Gaynor".

Portions of documents 2 and 3 of Appendix B contain advice, opinions and recommendations of the staff and are being withheld from public disclosure pursuant to exemption (5) of the Freedom of Information Act (5 U.S.C.

552-(b)(5)) and 10 CFR 9.5(a)(5) of the Commission's regulations.

Documents 2 and 3 of Appendix B with exempt portions-deleted are also located in PDR F0IA Folders77-239, "S. Turner", and 77-A-50, "K. Gaynor".

Pursuant to 10 CFR 9.15 of the Commission's regulations, it has been determined that the information withheld is exempt from production or disclosure, and that its production or disclosure is contrary to the public interest.

The person responsible for the denial of the withheld portions of document 1 of Appendix B is Mr. Kenneth S. Pedersen, Director, Office of Policy Evaluation.

The person responsible for the denial of the. withheld portions of documents 2 and 3 of Appendix B is Mr. James L.
