Dear Mr. Scherer:
In your letter to Mr. Frank Miraglia dated September 18,1987, which transmitted Revision 12 Chapter 1 of CESSAR-DC, you requested clarification as to the category and limit of fees to which Combustion Engingering (CE) will be liable for the review and processing of the System 80 design through design certification. Undgr the current provisions of 10 CFR 170, approval of the System 80 design certification is subject to fees based on actual costs.
10 CFR 170.12(e) requires that the fees be billed et six-month intervals as the review progresses. However, on March 5,1987, the Comission decided a phased recovery of fees for design approvals such as your System 80,on design.
If the design is not referenced or it all the review costs are not recovered within 10 years, Combustion Engineering would be responsible for any payments still due at the end of the ten-year period. Costs for preliminary and final design approvals, while e
effective, would be recoverable in five years, but extended to 10 years if the design is certified, such as you are proposing in your application dated September 18, 1987. While 10 CFR 170 has not yet been revised to include this change, we are not billing companies for reviews at six-month intervals as specified in the current Part 170 because of the Comission's decision of March 5,1987.
In addition, 10 CFR 170 currently has a ceiling for PDA and FDA approvals and requires application fees for initial applications in the amount of $50,000 and for amendments to PDA/FDA's in the amount of $150.
Application fees are no longer being required to be remitted at the time 1
of filing for any type of standardized design approval /certificatior.
i and all reviews, whether they be PDA/FDA or design certifications, will be subject to full cost recovery.

Scherer, Director JAN 181986 In suunary, whether System 80+ is considered an extension of FDA-2 or approved as a separate FDA for design certification, it will be subject to full cost recovery payable in 20 parcent increments as referenced, but not later than 10 years from the certification issuance date.
