RESPONSE OF HOUSTON LIGHTING & POWER COMPANY TO j
TEXAS UTILITIES GENERATING COMPANY MOTION FOR PARTIAL CONSOLIDATION In its November 16, 1978, Motion for Partial Consoli-dation in the above proceedings.
(" Motion" ), Texas Utilities Generating' Company moved the Board in both proceedings to consolidate discovery (Motion at 1) and to partially consolidate hearings as to common issues.
(Motion at 3.)
The Motion contem-plates separato hearings on issues pecular to only one application, and separate initial decisions.

Texas Utilities Generating Company ("TU") is an Applicant in Comanche Peak and an intervenor in South Texas Houston Lighting j

(" Houston") is an Applicant in South Texas but has not sought to intervene in Comanche Peak.
As to discovery, Houston supports TU's Motion for Consolidation of discovery phases of the two separate proceedings.
As to evidentiary hearings, Houston urges that a decision on TU's Motion be deferred until discovery is substantially i
completed.
Houston submits that the merits (and demerits) of consolidation of the evidentiary hearings are too speculative for rational decision-making at this time.
The hearings themselves are sometime away; the motion, premature.
Other present uncertainties argue for deferral of the motion as to hearing consolidation.
As TU observes in its Motion, "there are some aprties to one proceeding who are not parties to i
the other.
(Motion at 4.)
At this time, the contentions which will be litigated in Comanche Peak have not been identified.
Moreover, as TU states, "one proceeding may experience signifi-j cant delays not experienced in the other proceeding."
(Motion at 4.)
The hearing schedule for either proceeding is currently unknown.
Finally, the extent of hearing consolidation which would result from granting of the motion is not predictable.
With differing participants and potentially differing contentions at issue in the two proceedings, even TU seeks "[sleparate hearings.

r well.as separate initial decisions in each proceeding.

Pursuant-to 10 CFR-92.715a and S2.716, any party _to either proceeding may. seek severance of' specific issues to'further the ends of-justice or to avoid prejudice.
At this time it is not known whether, if TU's motion were to be granted, the amount of separate hearings would be de minimus, orLcontrolling.

For this reason the Board in each proceeding should consolidate discovery, a matter of bnmediate concern and action.
However, for the reasons stated above, the Board in each proceeding should defer ruling l
on TU's motion for consolidation of the evidentiary hearings until discovery is substantially completed and the hearings near.
