SAFETY EVALUATION BY THE OFFICE OF NUCLEAR REACTOR REGULATION SUPPORTING THE ORDER TERMINATING FACILITY OPERATING LICENSE NO. R-4 BATTELLE MEMORIAL INSTITUTE, COLUMBUS DIVISION DOCKET NO. 50-6

1.0 INTRODUCTION

By asplication to Materials License SNM-7 submitted by letter dated Marci 6, 1987, and by the resulting Amendment No. 2 to Materials License SNM-7 dated June 2, 1987, The Battelle Memorial Institute, Columbus Division (Battelle) requested from the Nuclear Regulatory Coninission (NRC) authorization to terminate Facility Operating License No. R-4. Reactor operations ended in December 1974 and the fuel was shipped offsite. On March 10, 1975, Facility Operating License No. R-4 was amended to permit the licensee to "possess but not operate" the facility. By order issued on March 19, 1975, the Battelle Research Reactor (BRR) was dismantled in accordance with the NRC approved "Dismantling Plan for the Battelle ,

. Research Reactor". When dismantling was completed, possession of the byproduct material in the remaining reactor structure was authorized under the existing possession only license. On March 6, 1987, the licensee applied for an amendment to Materials License SNM-7 which would authorize possession of the byproduct material in the remaining structure of the research resctor. This amendment to Materials License SNM-7 was issued on June 2, 1987.

2.0 EVALUATION The possession of the retired facility will be in accordance with Batte11e's application for amendment to Materials License SNM-7. Under Facility Operating License No. R-4, Batte11e's Radiation Safety Officer had served as the Retired Facility Site Representative, performing radiological surveillance, and preparing periodic surveillance reports for submittal to NRC. These provisions are incorporated into Materials License SNM-7.

Inasmuch as both Facility 0)erating License No. R-4 and Materials License SNM-7 have been issued to t1e same organization at the same location, and the activity under the licenses conducted by the sane personnel, the termination of Facility Operating License No. R-4 is administrative in nature. The health and safety of the public and workers are unaffected, and there is no impact on the public or environment by either the transfer of the byproduct material from Facility Operating License No. R-4 to Materials License SNM-7 or the termination of Facility Operating License No. R-4.

3.0 ENVIRONMENTAL CONSIDERATION

This order involves changes in the category of recordkeeping, reporting, and administrative procedures and requirements. Accordingly, this order meets the eligibility criteria for categorical exclusion set forth in 10 CFR51.22(c)(10). Pursuant to 10 CFR 51.22(b), no environmental impact statement or environmental assessment need be prepared in connection with the issuance of this order.

4.0 CONCLUSION

Based on the foregoing considerations, the staff concludes that Facility >

Operating License No. R-4 can be terminated without undue risk to the health and safety of the public or workers, and without any significant impact on the public or the environment.
