Dear Mr. Smith:
This is in response to your application, dated July 30,1996, requesting amendment to Apgee's registration certificates to authorize manufacture of previously approved Berthold devices in the United States. Based on the statements and requests contained in your letter dated December 20,1996, in response to our Confirmatory Action Letter (CAL), dated June 19,1996, and on our telephone conversation on January 15,1997, we consider your application as having been abandoned by you, and are returning the application to you without further action.
In our telephone conversaCon you indicated that Apgee Corporation has no intention to pursue amending its registration certificates to include modifications to the designs of the devices or to authorize the distribution of devices containing these design changes. You further indicated that Apgee wishes to ensure that devices that have been distributed in the past that do not conform to the approved design in the registration certificates be authorized for continued licensing and use in the field. To this end we will review - on a case-by-case basis - each registration certificate and the differences from the approved design identified in your letters dated August 12,1996, October 15,1996, and December 20,1996, to determine the acceptability for continued licensing of the devices and the need for amendment to the registration certificates.
Per your request during our telephone conversation on January 15,1997, we will proceed with the review of your application for registration of the Model LB 3100 series devices following resolution of the issues identified in the June 19,1996, CAL.
