Dear Mr. Chairman:

In your letter of January 28, 1988, as part of the Subcomittee on General Oversight and Investigations' continuing interest in the role of the Office of Investigations (01) within NRC, you requested among other things that the Subcommittee be provided with an 01 briefing paper regarding the investigation of alleged material false statements by Steven White of TVA, a draft 01 report on the same subject, and related memoranda. The other documents responsive to your request are being assembled and will be forwarded to you shortly. I respectfully request, however, that you permit us to delay providing the previously mentioned documents concerning the TVA l

investigation.

1 The NRC investigation is still in an "open" status with the Report of

Investigation in the final stages of preparation. The draft O! report to which you refer remains internal to 01 and has not been forwarded to the Conunission at this time. The question of what enforcement action, if any, is warranted by the facts developed by the investigation has not been addressed by the Comission. Also, the Department of Justice has advised, censistent with their general policy in such matters, that these documents sheuld not be disclosed at this time because the case has been referred to the Department for prosecutorial review.

It is our understanding that they are currently studying the investigative record to determine whether to pursue a criminal prosecution and are awaiting the 01 Report of Investigation before making a final determination.

d In light of the on-going civil and criminal enforcement process, we respectfully request that you allow us to defer honoring your request for the relevant investigativs documents.
