Dear Mr. Felton:

I acknowledge your dental of categories 1 and 2 of my Petition and your unsatisfactory answer equivalent to a denial to the categories 3 and 4 of my Petition. ,'

l. The fraudulent Zion computer program according to Mr. F. Maura of R III who presented evidence to this effect, was used by him to analyze the fraudulent 1983 Zion test. The evidence has been appended to transcripts of the meeting of NRC with myself on October 17, 1985.

The presentation transcripts are in the same volume. I f, as you say, these records are no longer with NRC,you must present information on their destruction, and, in accordance with 10 CFR, paragraph 9.4 you must obtain the same information again.

REQUEST 1. Relepse the fraudulent Zion computer program. If the print-out is not ready available, the magnetic record (diskette or a tape) is acceptable, the blank diskette will be provided by myself.

2. The suspect fraudulent Palo Verde I computer program appears to have options similar to fraudulent options of fraudulent LaSalle and Byron computer programs. I am in a possession of LaSalle and Byron programs, I have filed an emergency relief Petition to terminate their use.

This justifies your request to the Arizona Utilities for the release of the listing of the suspected program into the public domain which you have the right and obligation to present in accordance with 10 CFR paragraphs 9.3-9.6.

REQUEST 2. Release the suspect Palo Verde computer program.

3. Although your response formally does not deny my request for a list of records including the correspondence between the Arizona Utility 8 $ Company and Region V, you do not provide such list. Therefore, your 54 actions or inactions are qualified as a denial.

En REQUEST 3. Release the list of correspondence between Arizona Utilities T and Region V regarding the faulty test.

O 4 g<f 4. You have provided only an infinitesimally small fraction of the ooJ records which are, according to Mr. Maura of R III, in his possession.

" appealed" our initial Freedom of In'ormation Act (F0IA) response to F01A-85-724 in a letter to you dated December 9, 1985.

Your letter of December 17, 1985, is not an appropriate " Appeal from an Initial F0IA Decision" as no documents subject to your request were denied.

In response to categories one and two, we again requested the staff to search for records and have been informed that it has none subject to your request.

, In response to category three, the document identified on the Appendix A, which was enclosed with our December 9 letter, is the only document subject to category three of your original request.

In response to category four, we again requested the staff to search for records and have been informed that it has no additional records subject to your request.

This completes NRC action on your request.
