Dear Mr. Cdnnor:
Thank you for your interest in the role of the Nuclear Regulatory Commissien (NRC) with respect to the Savannah River Site (SRS) as expressed in your letter of January 16, 1992. Under provisions of the Energy Reorganization Act of 1974 and the Nuclear Waste Policy Act of 1982, NRC does not have jurisdiction over activities at the SRS. Therefore, it would be inappropriate
-for the Commission to undertake a review of the Draf t Federal facility Agreement as you have suggested, if, however, an environmental 1mpact statement were prepared to address the proposed cle&nup cctivities, we would provide comments, as available resources permit, in the areas of our expertise.
Section 202 of the Energy Recrganization Act of 1974 limits NRC's jurisdiction o,cr Departnent of Energy (DOE) facilities to these "...for the express purpose of ' subsequent long-term rtorage of high level rediriactive waste..."
Our position on NRC's jurisdiction over high level waste and decontaminated salt at SRS is presented in the advanced notice of proposed rulemaking publisheo on February 27, 1987, 52 FR 5592 (Encloscd).
Tr,this notice, we conclude that DOE facilities for inIerim stordge of high level waste canisters are not subject to NRC jurisdiction.
Regarding the NRC's review of the waste at Hanford, Washington, we are actively reviewing a petition for rulemating from the States of Washington and Oregon on this metter. The Conaission's role at SRS will of course be consistent w'th any principles or criteria established in response to that petition.
Therefore, we would expect to apply the same criteria on separation of the high level waste from the tanks at SRS, consistent with our jurisdictional limitt explained above, r
