U.S. Nuclear Regulatory Commission Public Meeting Summary May 22, 2020

Title:

Public Meeting to Discuss the Status of Rulemaking to Align Licensing Processes and Apply Lessons Learned from New Reactor Licensing Meeting Identifier: 20200416 Date of Meeting: April 29, 2020 Location: Slide presentation via Skype and Operator-assisted Bridge line Type of Meeting: Category 3 Purpose of the Meeting:

The purpose of the meeting was to support additional public interaction on the rulemaking to align licensing processes and lessons learned from new reactor licensing as described in SECY-19-0084, Status of Rulemaking to Align Licensing Processes and Lessons Learned from New Reactor Licensing (RIN 3150-AI66) (Agencywide Documents Access and Management System (ADAMS) Accession No. ML19161A169). The staff also provided a status of the rulemaking as described in SECY-19-0084 and addressed public comments received since the last public meeting.

General Details:

The meeting was noticed on the NRC public website (see meeting notice and agenda listed under References below).

The meeting was scheduled from 1:00 p.m. - 3:00 p.m.; however, the meeting adjourned at 2:15 p.m. after the conclusion of the question and answer period.

Approximately 59 people participated in the meeting remotely using a teleconference line.

Summary of NRC Presentation:

Ms. Anna Bradford, Director of Division of New Reactor and Renewal Licensing in the Office of Nuclear Reactor Regulation, provided opening remarks. The NRC staff provided an overview of the rulemaking process, status, and schedule (see NRC presentation and meeting transcript listed under References below), followed up with a discussion regarding the scope of the regulatory basis and provided specifics regarding some of the items being considered for rulemaking by the staff. The NRC staff then discussed several recently received public comments and offered members of the public to ask questions or provide comments. After conclusion of the question/comment session, the NRC staff summarized next steps and concluded the meeting.

Public Participation Comments and Questions:

During the discussion of public comments portion of the meeting, comments and questions were offered by industry stakeholders Mr. Michael Tschiltz, of the Nuclear Energy Institute (NEI), Mr. Gary Becker of NuScale Power, LLC, Ms. Amy Chamberlain of the Southern Nuclear Company, and Mr. Peter Hastings of Kairos Power. They discussed several topics of interest and asked follow-up questions and provided comments related to the scope of the rulemaking, opportunities for public involvement, and the rulemaking schedule.

Questions and comments discussed by the public included, but not limited to, opportunities for adjusting the scope of the rulemaking after the publication of the regulatory basis document; interactions with the public and engagement with the industry during the rulemaking process; delays in issuance of combined licenses due to errors in certified design, clarification of the definition of Tier 2*, transparency of the NRC decision-making process as it relates to consideration of Vogtle Units 3 and 4 License Amendment Requests in the rulemaking process, and the definition of the term essentially complete in 10 CFR Part 52, Licenses, Certifications, and Approvals for Nuclear Power Plants.

The stakeholders communicated that they appreciated the information presented by the NRC staff, the opportunity to discuss their respective comments on the rulemaking efforts, and the NRC staffs responses to the comments and questions.

Action Items/Next Steps:

  • The NRC staff is expecting to complete the regulatory basis and issue it for public comment in late 2020.
