SUBMITTAL OF THE AP600 APPLICATION UNDER OATH OR AFFIRMATION

Dear Mr. Liparulo:

It has come to the attention of my staff that revisions to the standard safety {

analysis report (SSAR) for the AP600 have not been submitted under oath or affirmation. This practice does not comply with the regulations.in 10 CFR Part 52. Specifically, 10 CFR 52.45(d) states in part that the applicant for a standard design under Subpart B

...must comply with the filing requirements of 10 CFR 50.30(a)

(1)-(4), and (6) and 50.30(b) as they would apply to an applica-tion for a nuclear power plant construction permit...." (emphasis added).

10 CFR 50.30(b) states the following:

"Each application for a license, including whenever appropriate a construction permit, or amendment of it, and each amendment of each application must be executed in a signed original by the applicant or duly authorized officer thereof under oath or affir-nation" (emphasis added).

Therefore, it is required that the next revision to the Westinghouse SSAR be submitted under oath and affirmation. In order to correct the problem for past revisions to the SSAR that were not submitted under oath and affirmation, Westinghouse is required to take the following actions.

(1) In the next revision to the SSAR Westinghouse will provide a statement under oath or affirmation that all previous revisions that are in effect (based on the List of Effective Pages) are true and correct.

(2) The process described above will also have to be implemented for the Probabilistic Risk Assessment and the Certified Design Material for the I AP600 because these documents were also not submitted under oath or affirmation.

y2)i h (3) All future material that Westinghouse submits for the AP600 for staff review must be submitted under oath and affirmation.
