-4 Good afternoon again. This is an affirmation 5 session. We have one item to come before us this afternoon.

6 Before I ask the Assistant Secretary to lead us 7 through the item for affirmation, do any of my fellow

$ 8 commissioners have any opening comments?

i 10 CHAIRMAN JACKSON: If not, Ms. Vietti-Cook, please 11 proceed.

12 MS. VIETTI-COOK: This is an affirmation on Ralph 13 L. Tetrick.

3 14 The Commission is being asked to act on an order 15 responding to the staff's petition for Commission review of 16 both the Presiding Officer's Initial Decision, LBP-97-2, and 17 his Order Denying Reconsideration, LBP-97-6. The 18 Commission's order remands one issue, the correctness of 19 Mr. Tetrick's response to Question 63 of the written exam, j 20 to the Presiding Officer and issues.a temporary stay 21 preserving the status quo until the case's final resolution.

22 The Commission has voted to approve the Memorandum 23 and Order remanding the issue of Question 63 and issuing a 24 " housekeeping" stay as attached.
