Task Order No.13 Entitled, "Envirocare Evaluation Background Aquifer Aqueous Activity," Under Contract NRC-02-96-004 This confirms verbal authorization provided to Sharon Rowe from Deborah Neff on February 13. 1997, to commence work on February 18, 1997, with a temporary ceiling of $3.300.00.

In accordance with the task order procedures of the subject contract, this letter definitizes Task Order No.13. This effort shall be performed in accordance with the enclosed Statement of Work and the Contractor's technical 3roposal dated February 24. 1997, and revised on April 1,1997, which are 1ereby incorporated by reference and made a part of this task order.

Task Order No.13 shall be in effect from February 18, 1997 through September 26, 1997 with a cost ceiling of $18,736. The amount of $

represents the total estimated reimbursable costs, the amount of $

represents the cost of facility capital, and the amount of $

represents the fixed fee for this task order.

The amount currently ob1'igated is $18,736.00.

The obligated amount shall, at no time. exceed the task order ceiling. When and if the amount (s) paid and payable to the Contractor hereunder shall equal i

the obligated amount, the Contractor shall not be obligated to continue performance of the work unless and until the Contracting Officer shall increase the amount obligated with respect to this task order. Any work undertaken by the Contractor in excess of the obligated amount specified above

YES 1.0 Backaround Envirocare of Utah. Inc. (Envirocare) has requested that the NRC review, and ultimately approve. its request to consider that all' recently-measured values for arsenic and any other groundwater constituents at its South Clive. Utah facility replace the currently-established background limits rather than being considered as exceedances of the existing background concentration limits.

If approved by NRC a license amendment would be issued.

2.0 Ob.iective 1

The objective of this task shall be to review the documents submitted in support of the above recuest: generate requests for additional information (RAI's) as required. anc review the responses to those requests.

Following resolution of the responses to all outstanding RAI's, the CNWRA staff shall prepare a report (hereafter Report) documenting its findings, including its recommendations relative to the technical appropriatene's of the replacement s

of the existing background concentration limits (see Envirocare licensee Table S-1 "NRC-Approved Background Concentrations") and NRC-Approved Site-Specific Standards (see Envirocare license Table STD-1) with a new background concentration limits Table S-1.

The report is to include the CNWRA's basis-for making such recommendations.

If such table replacement is warranted. and as directed by the NRC. CNWRA shall develop the replacement Table S-1.

3.0 Technical Oualifications Reauired The CNWRA shall provide the services of a geochemist. and a geohydrologist if needed. Familiarity with the Nuclear Regulatory Commis, ion regulatory process is required.

The NRC staff will brief relevant CNWRA staff on the proposed license amendment. either by phone or meeting.

CNWRA staff shall review the licensee's draft Technical Memorandum

" Evaluation of Background Aquifer Aqueous Geochemistry" (Technical Memorandum) and other materials (such as meeting hand-outs) as may be provided by the licensee prior to toe meeting described below in order i

to participate in, and provide verbal comments / reactions to, the licensee's presentation and requests at the meeting.

CNWRA staff shall attend and participate, either in person nr by telephone /videoconference. in the February 18. 1997. meeting with i

Envirocare at NRC Head Quarters (HQ) Office.

4.

Following the above meeting the CNWRA staff shall conduct such activities as required in order to acquire familiarity. with all background information necessary to accomplish this task.

Although not anticipated. CNWRA staff may be requested to prepare questions that can be sent to the licensee as requests for additional information (RAI).

The Technical Memorandum. currently scheduled to be finalized by the licensee, on or about March 1. 1997. shall be reviewed and, as required.

RAI's shall be prepared and shall be sent to the NRC for transmittal to the licensee.

During the review. relevant NRC staff will be available

to answer cuestions the CNWRA staff may have on this project.

It is anticipatec that a small portion of the review shall be conducted at the NRC HQ Office by CNWRA staff. Other documents as may be submitted to the NRC by the licensee in support of this task are to be reviewed by CNWRA with the development of appropriate RAl's as directed by the NRC.

CNWRA staff shall also participate, as requested by NRC staff. in face-to-face or telephone /videoconference interactions with the licensee

'3 to resolve technical concerns and comments generated by the review as well as requests for explanations about fee recoverable charges.

The face-to-face interactions may be at locations other than at NRC H0 Office.

In the event it is requested by the licensee. it may be necessary to visit. Inspect and evaluate a laboratory (s) being considered by the j

licensee as a specialist in analyzing an aqueous environment (high salinity solution) such as that present at the licensee's site.

A draft of the Report shall be sent to the NRC.

Draft input shall include: (1) a summary of CNWRA's review activities, including documents reviewed and conclusions reached. (2) the rationale for acceptance of the licensee's responses to each of the RAl's. (3) its recommendation relative to the technical appropriateness of the replacement of the existing background concentration limits with new background concentration limits (Possibility 1). or. conversely. a summary of the i

reasons underlying its recommendation not to replace the existing background concentration limits (Possibility 2). (4) a detailed technical evaluation documenting the CNWRA's possibility selection as well as its basis for rejection of the alternate possibility identined in (3), and (5) if Possibility 1 is recommended the Report is to include 2

i a table replacing existing license Table 5-1 (NRC-Approved Background Concentrations).

NRC staff will. review the draft Report.

Incorporating NRC staff connents, the Report shall be transmitted to the NRC.

7.0 Meetina and Travel j

NRC records, which cannot be readily provided. may have to be researched._ In addition. it is anticipated that a small portion of the review and report preparation shall be conducted at the NRC HQ Office by CNWRA staff.

Some trips to search NRC records and to consult with NRC staff may be necessary.

It is estimated that 1 one person trip of three day duration to the NRC HQ Office may be required.

CNWRA staff presence will also be required at meetings with the licensee.

Although meetings will generally be held at the NRC H0 office the possibility exists that meetings may be held at other locations.

It is estimated that one, one person trip for 3 day duration ta Salt Lake City, Utah may be required.

2 days 24 10.0 Technical Direction Technical instructions may be issued from time to time during the duration of this task. Technical instructions shall not constitute new assignments of work or changes of such nature as to justify an adjustment in cost or period of performance.

Directions for changes in the scope of work cost, or period of performance shall be coordinated through the NMSS Project Manager.
