PROGRNIS FILED PURSUANT TO SECTI0tl 70.57_
In August 1975, the Comission published Section 70.57 in the Federal l
Register, which concerned a neasurement control proaran for special l
nuclear materials control and accounting. This regulation reauired l
certain S!P1 licensees to submit their measurenent control preorams by Novenbar ll, 1975.
Procrans were submitted as recuired by Section 70.57, but were not actually reviewed or acted upon by the Safeguards Licensing staff until nid-1977.
According to discussiens between James Partlow, Chief, tiaterials Centrol Licensing Branch, Division of Safeguards, and Doug t.'eiss of ny staff, Mr. Partlow infomed us that there was an unintentional delay in revicwino the proqrans at the time they were subnitted in 1975 and early 1976.
'! hen the review finally began in mid-1977, it was detemined that all the programs lacked sufficient infomation for approval. A committee was then fomed in the Division of Safeguards to establish licensing review criteria and a draft guide for resebnitting the required infernation under Section 70.57. As a result, on '!ovenber 17, 1977, a letter was nailed to 19 licensees requesting that they resubmit their measure-ent control programs in accordance with the draft 70.57 guide. ?!o deadline for filine was niven other than a request for prcept resubnission.
Program modifications are now beinq submitted in response to the tlovenber letter, and the aporoval of these prograns will result in amendments to the respective licenses.
!!omally, fees would be charged for the review and anproval of caterials control and accountina programs; however, due to the two-year licensing l
delay in reviewino the original proqrans, the amendnont fee is being l
uaived for those programs subnitted in response to Licensing's i:ovember 17, 1977 letter. Once the procrans have been approved by the Comission, fees will be charged for any subsequent modifications or amendments thereto.
