Dear Mr. Cabell:
This is in response to your letter of May 8,1978, concerning our March 22, 1978 application for amendment to license SNM-145.
We understand your position that our amendment request is not con-sidered as a part of the pending renewal of license SNM-145.
However, it is important for you to understand our position that the amendment. request should not have been necessary at.al1, and woiird not have been necessary but for the fact that our renewal has not been issued to date, despite the passage of considerable... time since our~ initial application for renewal.
The' operation in question has been evaluated consistent ~with the manner permitted in our renewal application and as such it has been thoroughly evaluated and found not to constitute a safety hazard.
However, the evaluation would not be permitted under our current license.
Thus we could be construed to be technically in non-compliance with the conditions of our license, which does not reflect the way we prefer to do things and which for all practical purposes is obsolete.
That an amendment should be necessary at all in this instance is unfortunate; that we should consider paying for review of the application is out of the question.
I request that you give serious reconsideration to whether your previous conclusion, that we should pay for such review, must inevitably be reached.
