SUBJECT: NOTICE OF VIOLATION AND PROPOSED IMPOSITION OF CIVIL PENALTY (NRC INSPECTION REPORT NO. 50-395/85-34)

An NRC. inspection was conducted on August 1 - September 6, 1985 of activities authorized by NRC Operating License No. NPF-12 for the V. C. Summer facilit The inspection included a review of operational safety verifications, a review of licensee actions in preparation for refueling, a special review of the program for evaluating off-normal occurrences, and follow-up on operating events. As a result of this inspection, failures to comply with NRC regulatory requirements were identified and, accordingly, an Enforcement Conference to discuss these matters was held in the NRC Region II Office on October 8, 198 The inspection report was issued separately on October 23, 198 Violation I in the enclosed Notice of Violation and Proposed Imposition of Civil Penalties involves the failure to meet the Technical Specification requirements for low head safety injection for approximately one hour and fifteen minutes when the plant entered Mode 3 on August 23, 1985. At 6:20 a.m. on August 23, 1985, the V. C. Summer plant entered Mode 3 (hot standby). At 7:35 a.m. the licensee determined that both trains of low head safety injection had been previously rendered inoperable by the closure of motor operated cold leg injection header

investigation determined that multiple personnel errors resulted in the closure of XVG-8888A at approximately 10:30 a.m. on August 22, 1985, and XVG-88888 at approximately 3:50 a.m. on August 23, 1985. 'T av This condition had existed since initial plant startup in October 198 The Westinghouse Site Service Manager had informed you of this potential problem on December 5, 1984 after a similar incident at the McGuire plant. You were again informed of the McGuire incident on March 22, 1985 via IE Inforraation Notice 85-23. Another opportunity to discover and correct the problem was missed following an August 24, 1985 reactor trip when an irregularity in the OP Delta T instrumentation response was identified but not properly evaluated. These failures to recognize the problem raise the significance of the violatio Violations I and II represent a breakdown in your management system for ensuring that conditions inconsistent with plant Technical Specifications do not develop or if they do, that they are quickly identified and corrected. To emphasize the importance of identifying and correcting plant conditions inconsistent with Technical Specification requirements, I have been authorized, after consultation with the Director, Office of Inspection and Enforcement, to issue the enclosed Notice of Violation and Proposed Imposition of Civil Penalties in the amount of Fifty Thousand Dollars ($50,000) for the violations described in the Notic These violations have been categorized as a Severity Level III problem in accordance with the " General Statement of Policy and Procedure for NRC Enforcement Actions,"

10 CFR Part 2, Appendix C (1985) (Enforcement Policy). The base civil penalty amount for a Severity Level III problem is $50,000. The escalation and mitigation factors in the Enforcement Policy were considered, and no adjustment of the base civil penalty amount was deemed appropriat You are required to respond to the enclosed Notice and should follow the instructions specified therein when preparing your response. In your response, you should document the specific actions taken and any additional actions you plan to prevent recurrence. After reviewing your response to this Notice, including your proposed corrective actions, the NRC will determine whether further enforcement action is necessary to ensure compliance with NRC regulatory requirement In accordance with 10 CFR 2.790 of the NRC's " Rules of Practice," Part 2, Title 10, Code of Federal Regulations, a copy of this letter and its enclosure will be placed in NRC's Public Document Roo The response directed by this letter and the enclosure are not subject to the clearance procedures of the Office of Management and Budget issued under the Paperwork Reduction Act of 1980, PL 96-51 l o
