i ATTACHMENT I VIOLATION (454/455-97005-07) 10 CFR 73.21(b) (3) (i) describes safeguards information to include " portions of safeguards inspection reports, evaluations, audits, or investigations that disclose... uncorrected defects, weakaesses, or vulnerabilities in the system."

10 CFR 73.55 (c) (9) (iii) requires licensees to protect as safeguards information, information required by the Commission pursuant to 10 CFR

73. 55 (c) (8) (Vehicle Control Measures) and (c) (9) (Bomb Blast Analysis).

10 CFR 73.21(e) states in part, "Each document... that contains Safeguards Information..

shall be marked " Safeguards Information" in a conspicuous manner to indicate the presence of protected information...."

10 CFR 73.21(d) (2) states, in part, "While unattended, Safeguards Information shall be stored in a locked security storage container."

Contrary to the above, during the inspector's review of the records pertaining to the vehicle barrier system (VBS), a memorandum from the Engineering Department dated March 7, 1996, was noted in the file system. The memorandum contained Safeguards Information which described some uncorrected vulnerabilities with some components of the VBS were.

The memorandum was not marked and protected as safeguards Information.

This is a Severity Level IV Violation (Supplement I).

REASON FOR THE VIOLATION The memorandum was an individual engineers opinion regaroing the weaknesses in the vehicle-Barrier System (VBS).

Each individual item had been discussed with Corporate Security and resolved.

The material was never subject to an evaluation as safeguards by the Security staff as it had not been seen, by security staff, prior to this inspection.

The apparent cause of this violation has been attributed to a failure to recognize and/or poor awareness of safeguards requirements by the engineer.

CORRECTIVE STEPS TAKEN AND RESULTS ACHIEVED 1.

The material was secured and placed within a locked safeguards information cabinet.

CORRECTIVE STEPS THAT WILL BE TAKEN TO AVOID FURTHER VIOLATION 1.

An annual training session of the full requirements for safeguards handling and classifying for individuals that are known to deal with safeguards information. This action will be tracked by NTS# 454-100 00507-01.

DATE WHEN FULL COMPLIANCE WILL BE ACHIEVED Full compliance was achieved on 10/24/96 when the memorandum was secured and maintained within appropriate safeguards information requirements.
