Dear Sir:

In Reference 1, the Authority requested exemption from the requirements of Sections III.L.1 and III.L.2.b of Appendix R to 10 CFR 50 to the extent that reactor coolant must remain above the top of the core during use of the alternate shutdown capability.

This request was based on a new analysis that justifies thirty minutes for operator action to institute control from the alternate shutdown panels.

In the attachment included with Reference 1, we summarized the methodology and results of this new analysis.

During a subsequent telephone conversation, NRC staff members requested further details on the new analysis.

Attached is a General Electric report entitled " Analysis to Extend Operator Action Time for Alternate Shutdown Panels in Support of FitzPatrick Compliance to Appendix R" which clarifies and expands on the summary included with Reference 1.

The report reaffirms the conclusions summarized in our exemption request.
