SUMMARY

OF JUNE 11, 1997, REGARDING 10 CFR PART 21 ISSUES.

On June 11, 1997, representatives of Siemens Power Corporation (SPC) met with representatives of the Nuclear Regulatory Commission (NRC) in Rockville, MD.

.The purpose of this meeting was to discuss 10CFR21 issues. SPC requested clarification on some definitions and sought guidance on the 10CFR21 process.

SPC questioned the definitions of " Deviation" and " Discovery." SPC also requested clarification on: 1) " substantial safety hazard" as used in'10 CFR Part 21, and 2) when the 60-day reporting requirement, as stated in 10CFR21, starts.

1 NRC staff stated that engineering judgement has to be used in determining whether a condition or situation is a " Deviation" as defined by 10CFR21. As to the 60-day reporting requirement, the staff stated that the clock starts when a vendor completes the paper work first identifying a deviation as

defined by 10CFR21. The staff also stated that some vendors voluntarily send 1

preliminary notifications to'the NRC to report potential deviation and defects.
