FFICL m On 3/24/86 Anthony /F0E filed a motion with theLicenskgrd forj an immediate stay of the operation of the Limerick # 1 reacter for the pur-pose of protecting ear health and safety which are threatened by the con-tinuing operation of the p1mt without the carrying out of required tests on about 150 check valves and isolation valves.
At a hearing before the Licensing Board in Philadelphia en 3/27/06 we asked thgt Board for a ruling on our motion for a stay which was in l
the Board's. hands at that time.
The Board refused to rule on our motion which petitioned for an immediate shutdown of the plant,to continue dur-(
the Boardh hearings and deliberations en our petitions against the issu-anoe of two amendments to License NPF-39 by NRC,authorising extentions of time for the carrying out of the required tests.
The Licensing Board's refusal to exercise its authority under 10CFE 2 788 (a) and (g) to grant a stay to preserve the status quo and protect us from the accelerating risk of valve failure with each successive hour's passing without the required tests, subjects us to the risk of severe con-gequences to our safety and even lives in the event of a nuclear accident l
precipitated by the failure of the essential valves which have not been i
tested to find whether they will function as required. We protested to the LB in our submissions and in oral presentation on 3/27 that the 150 essential valves were due to be tested last September and October and are now operating en borrowed time at 6 to 7 months beyond the 18 or 24 months o
l test limits.
Since this is an emergency situation involving the safe operation of the Limerick reacter we petition the Appeal Beard to exercise its author-e e
ity under 10 CFR 2 788 to grant an immediate stay, forfeiting'LB's function, l
by way of this motios for directed certification,and to order a temporary
,.sjsy and shutdown of the reacter until the required tests are completed.
