Vessel Material Surveillance Requirements.

The Commission, by a vote of 5-0*, approved a final j

rule modifying 10 CFR~Part 50. Appendices G and H.

The Commission also agreed that the Supplementary informa-tion be modified to note that the Commission is examining

thermal annealing of reactor vessels and that further I

revision to Appendix G may result from this examination.

You should modify the Federal Register Notice to note the above and return i t for signature and publication.

SECY 83-52A - Final ialemaking Concerning Licensed Operator Staffino at Nuclear Power Units and Oraft i

Policy Statement on Shift Crew Qualifications.

The Commission by a vote of 5-0*, approved a final rule (as attached) which requires (a) the presence of a person with a senior operator license in the control room at all times that a nuclear power unit is operating; and (b) provides a minimum number of appropriately on each shif t at all times.

Commis ioner Roberts also stated that:

"I have reservatl-is about both the rule and the policy statement.

The following concerns should be addressed by the staff in its implementation of the staffing measures:

(1)

With regard to the policy statement, I feel that the BS degree requirement for the combined SRO/STA will be difficult for licensees to mainta'in and, in some cases, will provide only limited improve-ments in the ability of an operating shift to handle-unexpected transients or accidents.

The staff should maintain a flexible policy in applying the "or equivalent" criteria to take into account relevant training and experience of operators.

This flexibility will allow the licensee's to select those SRO/ STAS who have demonstrated the characteristics and analytical abilities intended by the Commission when it established the interim STA policy.

With regard to the staffing rule, I am concerned that the SRO control room limitation is too restrictive.

I agree that the SRO should remain current with plant conditions and be immediately available to direct operator response; however, I am sure that infrer,uent and momentary excursions from the immediate. control room vicinity could be accommodated with little or no added public risk.

Flexibility in the implementation of this restric-tion is appropriate.

i "Section 201 of the Energy Reorganization Act, 42 USC Sec. 5841, provides that action of the Commission shall be determined by a " majority vote of the members present."

Commissioner Asselstine was not present when these items were affirmed but had previously indicated that he would have affirmed his prior votes.

Accordingly, the formal vote of the Commission was 4-0 in favor of the decisions.
